Court Order Regarding Valid and Rejected Claim Forms

This discussion / guide explains the judge’s Order on Claim Form Objection posted below.

 

Paragraph 1  (beginning with “a.  Bernice Appleby (Excluded time 1/4/03 – 1/7/030”).

 

This section lists claims that may otherwise be valid, except that the portion of the claim made for time before April 12, 2003 is “chopped off” as not valid.  A claimant listed in paragraph 1 will lose recovery for the time period listed as “Excluded Time”, but unless listed below, the portion of that claim made for times after April 12, 2003 is allowed.

 

Paragraph 2 (beginning with “a. Allan Bates (for Richard Bates”)

 

The court ruled that claims filed by representatives of deceased tenants / class members are invalid and rejected, unless the person filing the claim form was either the current Personal Representative or Affiant of the decedent’s estate.  Absent that status, the person filing the claim form lacked legal standing to represent the estate and the claim is rejected.

 

Paragraph 3 (beginning with “a. Heather Doan/ Jim Thacker”)

 

This section and the claims listed is intended to prevent a double recovery for a single tenancy.  That is, if two persons each submitted a claim form for the same time period and payments, then only one recovery is available, and the two claimants will be required to reach an agreement regarding how to share the recovery.

 

Paragraph 4 (beginning with “a. Kyle Jensen”)

 

Claim forms submitted after the June 15, 2017 cutoff date are untimely and denied.

 

Paragraph 5 (beginning with “a. Ashley Carter”)

 

These claims are rejected because they were either unsigned as of the June 15, 2017 cutoff date, or because the signatures varied in a significant and material manner between two claim forms.

 

Paragraph 6 (beginning with “a. Marie Christensen”)

 

These claims were either invalid as submitted, or had inconsistencies with the existing tenant data from Salem RV Park that could not be resolved through attempted contacts with the claimant.

 

Paragraph 7 (beginning with “a. Birdie Strickland”)

 

These claims had inconsistencies with the existing tenant data from Salem RV Park that could not be resolved through attempted or actual contacts with the claimant.

 

Paragraph 8 (beginning with “a. Bernice Appleby”)

 

Appleby - this tenancy existed only before April 12, 2003.

Araujo - moved in after SRVP stopped the unlawful activities.

Bedient - moved in after SRVP stopped the unlawful activities.

Clampitt - this tenancy lasted for 45 days or less.

Clark - moved in after SRVP stopped the unlawful activities.

Cunningham - moved in after SRVP stopped the unlawful activities.

Elmore - moved in after SRVP stopped the unlawful activities.

Gonzales - this tenancy lasted for 45 days or less.

Lally - moved in after SRVP stopped the unlawful activities.

Moxley - this tenancy lasted for 45 days or less.
